Legal Separation and Divorce Are Not the Same
While many people may think that a legal separation and
divorce is the same thing, there are some important distinctions between the two.
If you and your spouse are contemplating a divorce but don't actually want to file just yet, you may want to consider a legal separation. Unlike a period of separation in which you may just decide to live apart for some time, a legal separation is a binding document that is approved by a judge. It gives you certain benefits that you could not enjoy if you either separate for a short time or file for divorce.
During a period of legal separation, you will have access to your spouse's benefits, including medical benefits. If you simply cannot live with your spouse anymore but still want access to certain benefits, you will need to remain married, or legally separated, for a set period of time.
