Child Custody an Issue for Splitting Same-Sex Partners

Now that more and more same-sex couples are having children together, the issue of child custody in the case of separation has become an issue. A lesbian couple brought their case before several courts before a judge ruled on the custody of their baby.
The case went before an appeals court judge last week who ruled that both women would have custody of the child. One of the women donated the egg for the baby while the other woman carried the child. Since both women participated in the creation and raising of the baby, the judge ruled that both women should have joint custody.
This came as a relief to the woman who was initially denied custody of the baby. After hearing the case, the appellate court overturned the lower court's decision. As with any child custody case, the judge ruled that the outcome should always be in the best interests of the child.
