  Director Steven Soderberg Admits Paternity
Posted By Law Office of Michael Young

Famed director Steven Soderberg has been shamed into revealing that he is indeed the father to a baby girl in Australia after a brief tryst down under.

The mother of the child, Frances Lawrencina, brought this news to the public when she made a child support claim against the director after proving the paternity of their daughter, Pearl Button. In the papers filed for child support she said that they "had intercourse on many occasions" including the period when he was directing "Tot Mom" at the Sydney Theater Company.

At this time Anderson is seeking a formal declaration of paternity, as well as child support, for the daughter that she claims is Soderbergh's. According to Bernard Clair, Soderbergh's lawyer, his client was completely shocked by the allegations as he is still married to wife Jules Asner.  However, at the time of the supposed coupling, Soderbergh was separated from Asner and has indeed recognized that he is the father of the child.

LeCharles Bentley to Have Child Support Re-Evaluated
Posted By Law Office of Michael Young

LeCharles Bentley, former Browns center, is having his child support re-evaluated by the Ninth District Court of Appeals this week. Although the case began in Lorain County Commons Pleas Court in 2008, the Ninth District Court has ruled against him in the case of child support payments for his three children.

The former center, whose career was ended after a serious staph infection debilitated him, had been ordered to pay $44,000 a year in child support payments based on calculations involving his annual income. His lawyers argued that Bentley actually only made $145,035.96 for child support services, meaning that the court had made an error in their calculations.

While the appellate court did not agree with Bentley's legal team that the original court had abused its discretion, it did find the courts calculations questionable when it included certain portions of money as income questionable. One amount, $30,000 per year, would come from a $300,000 annuity from which ten percent would be drawn each year.

Jermaine Jackson Sought After for Child Support
Posted By Law Office of Michael Young

TMZ reported this week that Michael Jackson's older brother, Jermaine, owes so many back child support payments that he lost his car to creditors. A survey of court papers related to the case revealed that Jackson, 55, owes $91,921.55 in support to ex-wife Alejandra Oaziaza for 10-year-old Jermajesty and 14-year-old Jaafar. The pair split in 2008 after 13 years of marriage when Jackson found out that his ex had never divorced her first husband.

However, he had been ordered to pay $3,000 per month when they first broke up; he now claims that he earns only $1,448 per month. No proof of his income has actually been given to the Los Angeles Child Support Services Department. In light of the large amount due, the department has also convinced a judge to suspect Jackson's license until pays back the whole amount.

At this time Jackson is not giving comments to the press.

Mother and Three Children Killed Over Child Support Battle
Posted By Law Office of Michael Young

Tragedy struck a household in Tallahassee, Florida where a mother and her three children were found dead in their home. It seems that the murder could be related to a child support battle that Brandi Peters, 27, was having with the Antonio L. Anthony, the father of her children.

A court had ordered Anthony to pay $307 per month plus $22,925 in retroactive pay for 6-year-old twins Tamiyah and Taniyah. The twins, along with 3-year-old Joyante Segura, became victims of this horrendous crime. At this time police have spoken to Anthony as well as Henry Segura Jr., the biological father of Joyante.

Court records show that Peters was asking for child support from Segura Jr. as well in the amount of $744.47 per month and $20,100 in retroactive support.

Police have not named a suspect just yet, but critics are pointing to Anthony who has a tattoo of a handgun on his arm in addition to having served three prison terms over the past twenty years. The Florida Department of Corrections department stated that he was just released in May 2009 after having served four years for two counts of cocaine possession and grand theft of a motor vehicle.

Kirk Kerkorian Must Pay $100,000 Per Month in Child Support
Posted By Law Office of Michael Young

Even though Kira Kerkorian is not his biological daughter, billionaire casino mogul Kirk Kerkorian has finally agreed to pay $100,000 per month in child support, plus $10 million in back payments. Ex-wife Lisa Bonder Kerkorian admitted during a child custody battle that she had actually faked the DNA paternity results, claiming that took a sample of saliva  from Kirk's older daughter. Bonder states that the biological father is famed Hollywood producer Stephen Bing.

Attorneys for neither party are eager to comment on the much-publicized case. Bonder's lawyer Michael Trope refused to comment while Joseph Mannis, legal counsel for Kerkorian, took some time before responding to the Associated Press.

Bonder and Kerkorian were married for only a brief time following a long courtship, yet during that time Kirk raised Kira believing her to be his biological daughter. He now has joint custody of Kira who currently lives with her mother. The agreed-upon settlement states that Kira's mother will receive $100,000 per month until her daughter turns 19 or finishes high school. At that point the amount will be reduced to $50,000 per month. Included in allowable expenses are: equestrian expenses, school-related costs, car, food, travel, housing, tutoring, entertainment, pets, and hobbies.

Chef Murders Over Child Support Taunts on Facebook
Posted By Law Office of Michael Young

New sources say that a chef has been placed in jail for murdering his ex-wife. It is believed that the defendant, Adam Mann, killed his wife after she taunted him on Facebook for his failure to pay child support.

Allegedly, Mann used a hammer to beat 30 year old Lisa Beverly and then slashed her neck with a knife.

Jurors were told that the victim's body was found by her five-year-old son inside of their residence on the day of the murder, which occurred last September.

If he is convicted, 29-year-old Mann will have to serve a minimum of 24 years imprisonment.  During the trial, it was said that Beverly did not stand a chance of surviving the wound she suffered to her face, head, neck and body.

Before her death, it is reported that Beverly posted the following on her Facebook: "Now whose laughing? U've got done big time by the CS, so now leave us alone for good, your son hates u and so do I."

Man Gets 30 Days in Jail for Failing to Pay Child Support
Posted By Law Office of Michael Young

In West Sacramento, new sources say that a man pled no contest for failing to pay child support to his children.

According to the Yolo County Department of Child Support Services, 38-year-old Shawn N. Ruiz pled no contest to one count of Penal Code section 270, which is a misdemeanor in the state of California.  His charges occurred after he failed to provide for his children by not paying child support ordered by the court.

As part of his plea agreement, Ruiz will have to serve 30 days in county jail, three years of probation and fulfill an order to pay his court-ordered child support as one condition of his probation.  Ruiz was originally charged with three separate criminal counts, but two were dismissed in exchange for a plea.

Child Support Attorney Colin Anderson, who worked on the case, said, "We encourage parents who owe child support to come and see us so we can make arrangements to avoid the filing of criminal charges."

Child Support Collections Skyrocket in Illinois
Posted By Law Office of Michael Young

In the state of Illinois, experts are saying that tough economic times have led to many parents failing to make child support payments.  However, the state says that child support payments collected from unemployed parents skyrocketed in 2010.

Throughout the past few years, the money collected for child support has remained around $1.3 billion and money collected through unemployment pay garnishment in the fiscal year, which ended June 30th, remained comparable to previous years.

According to the Illinois Department of Healthcare and Family services, the boost in child support payments can be attributed to the improved collection process.  An agency spokesperson, Stacy Solano, said, "However, we do believe that in large part the increase is due to economic and employment conditions."

This past year, the state collected $102.9 million from unemployment benefits.  In 2009, that figure was $58.9 million.

Billionaire Does not Have to Pay Retroactive Child Support
Posted By Law Office of Michael Young

This week in Los Angeles, one of the richest men in the United States has been cleared of the need to pay his adult children retroactive child support payments following a lengthy legal battle.

Donald Bren, a wealthy property developer that has an estimated net worth of $12 billion, is ranked in Forbes magazine's list of the 400 richest Americans.  His children, 22-year-old Christie Bren and 18-year-old David Bren were seeking retroactive child support totaling $400,000 each month.

They argued in court that the payment Bren made to their mother, Jennifer McKay Gold, were well below what they would have been awarded had the case been settled in family court.  During proceedings, 78 year old Bren was described as being an absent father who was never there for the children.

It took the jury three hours to decide that Bren did not need to pay his children any more than the $9 million here ready paid in child support plus his commitment to pay for their education until the age of 25.

Woman Fakes Pregnancy to Get Child Support Payments
Posted By Law Office of Michael Young

In King County, local prosecutors are saying that a woman faked her pregnancy in order to get child support payments.  31-year-old Carmen L. Johnsen managed to get $3,500 in child support payments from a man who believed he was the father of her "unborn" child.

Johnsen was charged with theft, perjury in the first degree and forgery.  She even printed a fake death notice and claim that she had miscarried.

In December 2008, Johnsen told the man she was pregnant with his baby. The next month, she took two pregnancy tests, which were both negative.  Even though she knew she wasn't pregnant, she told the man that she had a history of miscarriages and would need to be on bed rest. Believing that she was pregnant with his child, the man gave her five checks worth $700 each from February 2009 to June 2009.

When the man discovered that she was not pregnant, he went to police.  It is also said that Johnsen tried to pressure the man into paying half of her medical bills which totaled over $9,000.

Man Jumps from Window to Avoid Paying Child Support
Posted By Law Office of Michael Young

In Chicago, it is reported that a man broke both of his legs while jumping from a third floor apartment window in an attempt to avoid police.  Allegedly, 35 year old Ronald McIntyre was not making child support payments, which is why officers came to his apartment.

Authorities say that they were trying to take McIntyre into custody when they were let into the building by a woman who said she did not know where he was. A child then pointed to a window in the back of the building and when officers looked, they say that McIntyre had jumped and was splayed on the ground.

Homeless Man Ordered to Pay Child Support
Posted By Law Office of Michael Young

In Los Angeles, an attorney with the National Coalition For Men (NCFM) reported that on July 28th, the California Supreme Court declined to review a Court of Appeal decision which forced a homeless man by the name of Hari Wilburn to pay tens of thousands of dollars in child support.  Even though DNA testing excludes Wilburn as being the father of the child and he never acted as the father, the motion was declined.

On August 17th, a probate court in San Diego will hear the mother's request to intercept Wilburn's inheritance, which he received from his deceased mother.  The mother wants the money to fulfill Wilbur's child support order.

Wilburn received representation from the NCFM, which is a non-profit organization that addresses how sex discrimination affects both men and boys.  In 2005, the NCFM helped chance California law in order to protect men from dales paternity claims.

Montel Williams at Center of Child Custody Dispute
Posted By Law Office of Michael R. Young

A well-known TV personality is involved in a legal dispute…with his own children!

Montel Williams, best known for his daytime talk show “The Montel Williams Show”, is being asked to step up to the plate by his own children. Although Williams is current on his $18,700-a-month child support payments, his two kids say they want their dad to start taking a more active role in their lives or step out of the way. They said if Williams isn’t interested in taking a more active involvement in their lives then he should step aside and let their mother make all of their legal decisions.

That is not their only request. The kids, ages 16 and 15, want Williams to pay for an attorney to argue their case. But according Williams’ own attorney, he is currently in an “extremely perilous” financial situation.

Despite his recent successes, which includes hosting radio show, writing a best-selling memoir, and staring as an infomercial pitchman, Williams claims he cannot afford to pay the $7,500 in legal fees his kids are asking for their lawyer.

Meanwhile, Williams’ custody fight with his ex-wife, Grace Morley, rages on. Although Williams and Morley currently have joint custody, his children say they rarely see their father. His daughter, Wintergrace, says she has only seen her father four times in the last five years. Morley is now trying to gain sole physical and legal custody of the children, but Williams is fighting to hold on to his legal custody rights so he can continue making legal decisions.

Child Support Mix-up – It Can Happen to You!
Posted By Law Office of Michael R. Young

State child support agencies crack down hard on people who fall behind on their child support payments, and will not hesitate to take whatever measures are necessary to recover past-due support. Garnishing wages, revoking driving privileges, and withholding tax returns are just some of the steps being states are taking to collect the support that is legally owed, and California is no exception. But what happens when the state makes a mistake and comes after the wrong person? Who can you turn to for help? While you may think it’s as easy as calling up child support services, sometimes it takes a lot more time and effort before a mix-up can get resolved. A Florida man found himself in a similar situation, and had to basically jump through hoops before he could get his mix-up resolved.

National Guardsman Rusty Cole, 22, had his tax return withheld because the state of Florida said he failed to make child support payments for a child born in 1995. At 22 years old, Cole would only have been 7 at the time the child was born, and possibly 6 years old when the child was conceived. Cole made numerous attempts to resolve the issue, putting in phone calls to multiple agencies and appearing in person. It wasn’t until he wrote an e-mail to Governor Crist that he was able to get any kind of relief. Shortly after sending the e-mail, Cole received an apology from the department of revenue, and was told his tax return would be mailed to him shortly. Even after receiving this apology, Cole is adamant in making sure this mistake never happens again.

San Bernardino County Collects Over $150 Million Despite Tough Economy
Posted By Law Office of Michael R. Young

The San Bernardino County Child Support Services was successful yet again in its child support collection efforts.

Until two years ago, the department saw a decline in the amount of support it collected. But now, despite the poor economy and the growing unemployment rate, the county was able to recover $151 million in child support last year. The previous year the county collected $153 million in support.

The county used a variety of collection techniques to recover the money, including intercepting tax refunds and stimulus checks, taking a portion of disability and unemployment benefits, and seeking real estate liens.

While the county is obviously pleased with its collection efforts, there is some concern that the job market will continue to affect parents’ ability to continue making payments. Following a job loss or layoff, a person ordered to pay child support may not be able to afford the payments. Instead of asking the courts for help, some people try to hide from the system.

Connie Brunn, director of the San Bernardino County Department of Child Support Services, urges parents who can no longer afford their child support obligations to come forward and ask for help. If the payments are too high, parents can request a modification to have the payment amount lowered. Many judges understand that people are struggling financially, and are willing to help those who show they genuinely cannot afford to make their current payments. When people try to hide or avoid their child support obligations, not only will they end up paying more  in the end due to a 10% interest rate, but the county is going to come after them.

Struggling to Make Your Child Support Payments?

If you have been ordered to pay child support, but due to extenuating circumstances are having trouble making your payments, please don’t hesitate to contact a San Bernardino child support lawyer at the Law office of Michael R. Young for help. We can help you request a modification from the court to get the payments lowered and negotiate a repayment plan with the court for any past-due support.

Beyoncé’s Father Ordered to Pay Child Support to Mistress
Posted By Law Office of Michael R. Young

There’s been a development in the paternity case involving superstar Beyoncé’s father. Last week we blogged about how Matthew Knowles’ alleged mistress asked him to take a DNA test, which he agreed to do. This week a judge ordered Knowles to begin paying the woman, Alexsandra Wright, $8,200 a month in child support, retroactive to February 1 st. Knowles must also pay 100% of Wright’s uninsured medical bills. The total for January was $20,750.

The judge’s decision comes despite the fact that Knowles was scheduled to take a DNA test on March 1. If the test proves Knowles is the father, long-term child support arrangements will need to be made.

Many people are speculating the judge’s decision is a sign that Knowles is indeed the father of the child, a boy named Nixon. What’s also interesting is that Knowles gave Wright $10,000 in January for medical expenses and other baby related costs.

Is Knowles the father? Nothing is certian, but it seems to appear that way.

If you are involved in a paternity or child support dispute, an attorney at the Law Offices of Michael R. Young can help. For more information about our services, please contact a Riverside family law attorney at the office today!

House Approves Measure to Use Casino Winnings for Child Support Debt
Posted By Law Office of Michael R. Young

Members of an Indiana house panel approved a measure that requires casinos in all areas of the state to check a database of people who owe back child support before cashing out a patron’s winnings. If a patron wins money at the casino and their name comes up in the database, the casino must refuse to pay out the winnings.

The Public Policy Committee approved the measure 10-0, however, several committee members expressed concern that the state was brushing off its responsibilities and mixing up its priorities.

One lawmaker said that although she likes that the bill favors single working parents, she fears the government is essentially passing off its responsibility to collect child support to private casinos.

Several amendments were made to the original bill, including one amendment that rewards the casinos for their efforts. After the Indiana Casino Association complained the bill would create headaches for the payout desk, lawmakers amended the bill to increase the amount casinos can charge for the processing fee. Instead of a flat $15 fee the casinos can charge 3% of the total child support owed or $100, whichever is less.

The bill now moves to the full house for a vote.

Are You Behind on Your Child Support Payments?

As of now, California does not have a similar law, mainly because gambling is illegal in California aside from on Indian reservations. However, should you fall behind in your child support payments, you can be certain the state will take appropriate measures to recover the money you owe. Withholding your tax return, garnishing your wages, and even refusing to let you renew your driver’s license are all tactics the state may use in its efforts to collect the support you owe.

  Bristol Palin Seeks Child Support
Posted By Law Office of Michael R. Young

Bristol Palin, the oldest daughter of ex Vice Presidential candidate Sarah Palin, is seeking  child support from her ex-fiancé, Levi Johnston.

Court documents show Palin asking for $1,750 a month for their 19-month-old son Tripp. Palin is also seeking $18,350 in back child support. She claims she is providing 100% of Tripp’s care and that Johnston only paid her a total of $4,440 in a little over a year.

The amount Palin is asking for is based on Johnston’s income last year.  Under Alaska law, the non-custodial parent is required to pay 20% of his or her adjusted annual income in child support.

Palin also filed for full custody back in November, but Johnston’s attorney says his client wants joint custody of Tripp.
